Terms of Service
These terms are an agreement between you and Appbrew ("we", "us") for use of The Brand Computer at thebrandcomputer.com (the "Service"). If you use the Service for an organisation, you accept these terms on its behalf and confirm you have authority to do so; "you" then includes that organisation. If you don't agree, don't use the Service.
1. The Service
The Service is an AI workspace for ecommerce businesses. It connects to tools you use (such as your store, ad, email, support and accounting accounts), answers questions, builds reports and dashboards, and prepares and makes changes in those tools at your request. We may change, add or remove features over time.
2. Accounts and organisations
- You must be at least 18 and provide accurate information. Keep access to your email and sign-in secure; you're responsible for activity under your account.
- An organisation's owners control who joins it, their roles and what they can reach. Members' access is limited by the roles the organisation sets.
- Tell us promptly at privacy@thebrandcomputer.com if you suspect unauthorised access.
3. Connected services
- When you connect a service you authorise us to access it and act in it on your behalf, within the access you grant and the work you request.
- Your use of each connected service remains subject to that provider's own terms and policies (for example the Google Ads, Meta, Shopify or Amazon terms). You're responsible for having the rights to connect the accounts you connect.
- You can disconnect a service at any time. We aren't responsible for third-party services, their availability, or changes they make to their APIs.
4. Your data
- You own your data: the content you provide and the data from your connected services ("Your Data"). We claim no ownership of it.
- You give us permission to host, process, transmit and display Your Data only as needed to provide, secure and support the Service, as described in our Privacy Policy.
- You're responsible for having a lawful basis and any notices or consents needed for the personal information you bring to the Service, including your customers' information. We process that information on your behalf and on your instructions.
- We don't use Your Data to train AI models.
5. AI output and actions
- The Service uses AI. Its answers, reports and proposed changes can be incomplete or wrong. Review them before relying on them, especially for financial, legal or customer-facing decisions.
- Changes that affect customers or spend wait for approval as your settings require. Once you or a member with the right role approves a change, or sets an automation to act, you are responsible for that change, including ad spend it causes.
- Output the Service produces for you is yours to use, subject to these terms and to rights others may hold in material you provide.
6. Acceptable use
You agree not to:
- break the law, infringe others' rights, or use the Service to send spam or deceptive advertising;
- access accounts, data or systems you aren't authorised to use, or try to get around the Service's access controls or limits;
- interfere with or overload the Service, or probe or attack its security (responsible disclosure to us is welcome);
- use the Service to develop a competing product by copying it, or resell it without our agreement.
7. Fees
Paid plans and usage charges (for example AI, compute, storage and email usage) are shown in the Service or in an order you agree to. Fees are due as stated there, are non-refundable except where the law or that order says otherwise, and exclude taxes. We'll give you notice before changing prices for your plan.
8. Suspension and termination
You can stop using the Service and delete your organisation at any time. We may suspend or end access if you materially breach these terms, if needed to prevent harm or comply with law, or for non-payment, with notice where reasonable. After termination you can ask for an export of Your Data for 30 days, after which we delete it as set out in the Privacy Policy.
9. Disclaimers
The Service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we don't promise the Service or AI output will be error-free, uninterrupted or produce particular business results.
10. Limitation of liability
To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, and our total liability arising out of these terms or the Service is limited to the amount you paid us for the Service in the 12 months before the claim (or US $100 if greater). These limits don't apply to liability that can't be limited by law.
11. Indemnity
You'll defend and indemnify us against third-party claims arising from Your Data, your connected accounts, or your use of the Service in breach of these terms or the law.
12. Changes to these terms
We may update these terms. We'll post changes here with a new effective date and give notice in the Service or by email before material changes take effect. Continuing to use the Service after that means you accept them.
13. Governing law
These terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, and disputes will be resolved in the state or federal courts located in Delaware.
